CENTRAL ISLIP, NY – October 14, 2026 – A standard DWI charge in Suffolk County can escalate into a felony when a crash causes serious physical injury or death, exposing drivers to years in state prison and mandatory license revocation. Central Islip DWI defense attorney Jason Bassett of the Law Offices of Jason Bassett, P.C. (https://jbassettlaw.com/practice-items/dwi-and-dui-defense/dwi-with-accident-injury-ny/) is providing guidance on how accident-related DWI cases become vehicular assault or vehicular manslaughter charges and what those facing them need to understand.
According to Central Islip DWI defense attorney Jason Bassett, an accident transforms a basic misdemeanor drunk driving charge into a felony the moment a collision results in severe harm. A standard first offense falls under New York Vehicle and Traffic Law Section 1192 and carries a maximum of 364 days in jail, but prosecutors file elevated charges under Penal Law Article 120 and Article 125 for vehicular crimes. “Many people don’t realize that a single crash can turn a misdemeanor into a felony carrying multiyear prison time, even for someone with no prior record,” explains Bassett.
Central Islip DWI defense attorney Jason Bassett notes that serious physical injury serves as the definitive legal trigger for these felony charges. New York defines this condition as an injury creating a substantial risk of death, serious disfigurement, or the long-term loss of a body part or organ function. Minor injuries do not meet this standard, but conditions such as broken bones or head trauma satisfy the legal definition and prompt immediate felony prosecution in Suffolk County courts.
Vehicular assault applies when impaired driving causes serious physical injury to another person, and it is defined in two degrees. Second-degree vehicular assault is a Class E felony under Penal Law Section 120.03, carrying up to four years in state prison. First-degree vehicular assault is a Class D felony under Penal Law Section 120.04, filed when an aggravating factor exists such as a BAC of .18 or higher, a prior DWI conviction within ten years, or serious injury to more than one person, and it carries up to seven years.
Bassett points out that the most serious injury-based charge is aggravated vehicular assault, a Class C felony under Penal Law Section 120.04-a carrying up to fifteen years in state prison. “A vehicular case requires prosecutors to connect the impairment directly to the crash and the crash directly to the injuries,” Bassett says. “Challenging either the reckless driving allegations or the statutory aggravating factors can reduce the charge to a lower felony or even a misdemeanor.”
When a DWI crash causes death, prosecutors pursue vehicular manslaughter charges under Penal Law Article 125. Second-degree vehicular manslaughter is a Class D felony under Section 125.12 carrying up to seven years, while first-degree vehicular manslaughter is a Class C felony under Section 125.13 carrying up to fifteen years when an aggravating factor such as a high blood alcohol concentration or a prior conviction is present. Attorney Bassett emphasizes that a fatality case demands immediate legal representation because evidence is gathered quickly and early defense work can shape the direction of the case.
A felony vehicular conviction also triggers mandatory license revocation, which terminates driving privileges entirely rather than placing a temporary hold on them. Bassett explains that a license can be suspended at arraignment before any conviction under New York’s prompt suspension law when a chemical test shows a BAC of .08 or higher. Drivers must reapply to the DMV once the revocation period ends, which lasts at least one year for felony vehicular convictions.
Bassett observes that a DWI accident frequently triggers separate criminal charges and civil lawsuits that proceed at the same time. Injured drivers, passengers, and pedestrians may sue to recover damages for medical bills, lost wages, and pain and suffering, and a criminal conviction can serve as direct evidence of fault in a civil claim. He advises those involved in a serious crash to avoid admitting fault at the scene, speaking with insurance adjusters without counsel, posting about the incident on social media, or accepting an initial plea offer before an attorney evaluates the case.
A former prosecutor with more than 25 years of experience, Bassett previously served as a Queens County Assistant District Attorney and a Suffolk County Principal Assistant County Attorney. He reviews the police accident report, chemical testing records, and formal charging documents to build a defense focused on each client’s specific circumstances, examining whether officers had a lawful basis for the stop, whether chemical testing followed proper protocols, and whether impairment actually caused the crash. The firm represents clients throughout Suffolk County and handles accident-related matters in Nassau, Queens, Kings, and Bronx counties as well.
For those facing accident-related DWI charges, contacting an experienced Suffolk County DWI defense attorney promptly may help preserve critical evidence and protect legal rights before evidence degrades and witness memories fade.
